Accredited Employer Work Visa (AEWV)

Immigration New Zealand mandates accreditation for employers if they wish to hire any migrant workers. During this process three factors will be assessed, namely the employer, the labour market, and the migrant worker. If all three pass evaluation the employer will be able to support employer-assisted work visas.

There are also considerations such as whether an employer should attempt to get accredited at a Standard or High Volume level. A Standard accreditation allows for upto 5 visas per year whereas the High Volume accreditation has no such limitation, however, rules governing the latter are far more exacting.

The above and many other details including new ICT systems are going to comprise the new rules governing employer accreditation which INZ intends to implement in 2022. If you are considering accreditation, please reach out to us and let us help you navigate the new rules and regulations.

As per recent announcement by INZ, new visa applications for accreditation for New Zealand employers will begin from 9 May 2022.

The Accredited Employer Work Visa Auckland is being introduced on 4 July 2022. You must be accredited to hire migrant workers on an AEWV.

Employers will need to meet minimum standards including:

Have an NZ Business Number, this will enable Immigration NZ to make certain checks with MBIE or through publicly available information.

You must be registered as an employer with Inland Revenue (IRD) Your business must be in a sound financial position (such as being profitable, having a positive cash flow or access to funding) Businesses operating for less than 12 months must provide evidence they are in a sound financial position

Support visa applications for your employees

What should you know about supporting your migrant workers?

A typical New Zealand business, large or small, has a workforce made up of New Zealand citizens, permanent residents, and migrants here on a temporary visa. Temporary visas are issued with varying work rights and quite often an employer is required to support a migrant’s work visa application in order for them to work (or continue working) for the employer.

As announced in November 2019, INZ has been working on a new platform and process to streamline the work visas.

These changes are to ensure that INZ continues to safeguard the employment interests of New Zealanders while also providing more certainty to the businesses in New Zealand who rely on migrant workforce. INZ believes that these changes will also help reduce instances of migrant exploitation.
Starting  July 4, 2022, a new Accredited Employer Work Visa (AEWV) will replace six pre-existing work visa classes. All employers supporting migrant workers with this new visa must be accredited.
Until then, an employer in New Zealand may continue to support their employees for an Essential Skills Work Visa. Find more information about our Accredited Employer Work Visa Auckland

All applicants to New Zealand are required to prove that they are of good character in order to obtain a visa. However, for the people who do not meet these requirements and require assistance, we help you comply.

Candour is at the heart of what we do at Counsel One. Where character waivers are required, outside assistance is critical. However, if after understanding your circumstance our experts will give you an honest estimate of your chances.

If we think your application has a chance, we will go above and beyond to make sure that you have the best chance of success. This can be a complicated and anxious process but we promise to be with you every step of the way.

Medical Waivers

For visas to New Zealand you must have an acceptable standard of health. However, if you or any family member in your application do not meet this standard. In such a situation, you can apply to Immigration New Zealand for a medical waiver to be considered.

The acceptance of a medical waiver depends upon the class of visa for which you apply. For example, in the case of a resident visa application, you must meet all of the other requirements for approval before a medical waiver will even be considered. If we think your application has a chance, we will go above and beyond to make sure that you have the best chance of success. This can be a complicated and anxious process but we promise to be with you every step of the way.

Appeals to the Immigration and Protection Tribunal

If your application has been declined by Auckland immigration advisers, you may be able to appeal the decision to the Immigration and Protection Tribunal (IPT). The IPT, which is a part of the Ministry of Justice, hears and determines appeals concerning INZ decisions on:
  • residence class visas
  • liability for deportation
  • recognition of a person as a refugee or protected person
If you need professional advice or assistance as this is a complicated process, please get in touch with us so that we can help you make the right decision.

Ministerial Intervention

Ministerial intervention is seemingly an effort of last resort. If you’re unlawfully in New Zealand, for example if your visa has expired and you’ve stayed behind, and your attempts have failed including a Section 61 request, you may request ministerial intervention.

Through this process, one can petition the Associate Minister of Immigration who acts on behalf of the Minister of Immigration. However, the Associate Minister is unlikely to look at your case unless it truly is the last resort and all other means have been exhausted.

If you appear to have reached the end of the road and you do not know which way to turn, consider reaching out to us for professional advice and assistance.
